Turkmenistan approved the rules for certification and registration of patent attorneys

The Ministry of Finance and Economy of Turkmenistan approved the Procedure for conducting the qualification examination and registering patent attorneys. The corresponding Order No. 7 was signed by Minister M. Astanagulov on January 15, 2026.

The document, for the first time, systematizes the requirements for individuals providing professional intellectual property representation in the country. It covers the entire life cycle of a patent attorney—from admission to the examination to removal from the register.

According to the Procedure, a citizen of Turkmenistan with a higher education in the natural sciences, engineering, or law, permanently residing in the country, and having successfully passed the qualification exam may become a patent attorney. Specializations cover five areas: inventions, industrial designs, plant varieties, trademarks, and appellations of origin.

The exam will be administered computer-based at least four times a year. To pass, you must answer at least 70% of the test questions correctly. The Qualification Commission is chaired by the Head of Turkmenpatent, and complaints against its actions are reviewed by a separate Appeals Commission.

The registration certificate is issued for five years and can be renewed for a subsequent similar period, subject to passing a re-examination. Information on all registered and disqualified agents will be published on the official Turkmenpatent website.

The document enters into force without retroactive effect, meaning it applies only to relationships arising after its enactment.
