Turkmen President Serdar Berdimuhamedov signed a law on scientific intellectual property, which regulates the creation and use of scientific intellectual property and aims to protect property rights to these objects. The document was published in the newspaper "Neutral Turkmenistan."
According to the law, objects of scientific intellectual property include monographs, dissertations, scientific reports, articles, and reports, as well as scientific and methodological materials derived therefrom. The law defines intermediate, final, and secondary results of scientific work as forms of intellectual property.
The document establishes that ownership of scientific developments belongs to their creators, but may be transferred to employers based on contracts. Developers of scientific intellectual property are entitled to remuneration and a share of the profits from the use of their creations.
The law provides for the possibility of assigning rights to scientific intellectual property to others, as well as using these rights as a contribution to the authorized capital of enterprises. Owners of the assets may demand compensation for damages in the event of infringement of their rights.
Funding for scientific intellectual property will be provided through the state budget, extra-budgetary funds, and revenues from the economic activities of scientific organizations.
The law will enter into force on the day of its official publication.
