In Turkmenistan, parents will be fined for smoking by children under 16

Amendments to Article 358 of the Code of Administrative Offenses, which addresses the liability of parents and guardians for the improper upbringing and education of children, will come into effect in Turkmenistan on May 1, 2026. The law was signed by President of Turkmenistan Serdar Berdimuhamedov on April 11, 2026.

A key innovation was the addition of Part Six to the article, which for the first time introduces direct administrative liability for parents for their children's violation of the ban on smoking tobacco products. If a minor under sixteen violates Turkmenistan's anti-tobacco legislation, parents or guardians will be required to pay a fine of one to two basic units.

In addition, penalties for several existing sections of the article have been adjusted. For Section 2, which concerns the unprescribed use of narcotics by adolescents under sixteen, the option to issue a warning has been eliminated: the violation now carries an uncontested fine of one basic unit.

Similarly, the penalties for Part Three have been standardized: for minors aged fourteen to sixteen years, the fine for petty hooliganism will also be one base unit. For Part Four, which regulates traffic violations by minor pedestrians, the fine has been increased from a fixed 0.4 to a range of 0.5 to one base unit.

At the same time, the list of exceptions to the provisions of Part One has been expanded: along with Parts Two and Three, Parts Two through Six inclusive have now been excluded from its scope of application, which brings the provision into line with the updated structure of the article.
