Turkmenistan has developed rules for remote trade

The Ministry of trade and foreign economic relations of Turkmenistan has developed "rules for selling goods remotely", which are designed to regulate the processes of online Commerce.

The Rules include General provisions for creating a remote trade, including advertising products, concluding a contract for the sale of goods, the procedure for delivering goods to the consumer, defining the rights of the consumer, and other items.

These rules apply to legal entities regardless of their organizational and legal form, as well as to individual entrepreneurs who carry out business activities without creating a legal entity.

The "rules for selling goods remotely" do not apply to entrepreneurs who enter into transactions, contracts and other types of transactions in wholesale trade using electronic documents, as well as to the sale of goods through vending machines, relationships arising from contracts for remote purchase of goods from abroad, purchase and sale agreements, tenders.

According to the rules, the following types of online stores can operate in the country:

  1. Online store as an additional platform for a working store;
  2. An online store that sells only from the supplier's warehouse on request, only through the site;
  3. An online store that has its own warehouse that sells only through the site. 

At the same time, an online store can combine several types (from its warehouse and sales on request).

It is forbidden to sell alcoholic beverages, tobacco products, dietary supplements, weapons and ammunition, audio-visual works and phonograms in the online store.

Trade in products made of precious metals and precious stones is carried out in accordance with the procedure established by the legislation of Turkmenistan.

Legal entities and individual entrepreneurs who sell goods remotely (including through online stores) are required to use electronic cash registers and provide the ability to make payments via a payment terminal. A cash receipt is issued directly at the time of payment for the product.

"Rules for selling goods remotely" were approved by the order of the Minister of trade and foreign economic relations of Turkmenistan dated July 14, 2020 and registered in the Ministry of adalat of Turkmenistan on August 3, 2020 for No. 1367.
