Additions and amendments to the Law of Turkmenistan “On Combating Corruption” published

Additions and changes were made to the Law of Turkmenistan “On Combating Corruption”, according to which the basic concepts used in the Law were supplemented with such as “anti-corruption expertise of normative legal acts and draft normative legal acts” and “corruptogenic norms”.

Anti-corruption expertise of regulatory legal acts and draft regulatory legal acts is an expertise that is carried out in order to identify and eliminate corruptogenic norms in regulatory legal acts and draft regulatory legal acts;

Corruptionogenic norms are provisions of normative legal acts and draft normative legal acts that establish unreasonably wide margins of discretion for the law enforcer or the possibility of unjustified application of exceptions from the general rules, and also provisions containing vague, difficult and burdensome requirements for individuals and legal entities and thereby creating conditions for offenses related to corruption.

In this regard, adalat authorities, prosecution authorities, other ministries and departments, local executive authorities, local governments and their officials are authorized to conduct anti-corruption expertise of regulatory legal acts and draft regulatory legal acts. The procedure for conducting anti-corruption expertise of normative legal acts and draft normative legal acts is approved by the Cabinet of Ministers of Turkmenistan.

The Law of Turkmenistan On Making Additions and Amendments to the Law of Turkmenistan “On Combating Corruption” was published in today's newspaper “Neutral Turkmenistan”.
