Kazakhstan has approved a draft law on ratification of the Protocol on the protection of industrial designs

In Kazakhstan, the Mejlis deputies approved the draft law "On ratification of the Protocol on the protection of industrial designs under the Eurasian patent Convention" to improve the regional system of patenting, according to кazakh-tv.kz.

The Protocol itself provides for several areas: legal protection of Eurasian patents for industrial designs, the principles of its operation, the rights and obligations of applicants, copyright holders, as well as the duties and powers of the Eurasian patent organization, whose members are 8 States that have ratified the Eurasian Patent Convention - Armenia, Azerbaijan, Belarus, Kazakhstan, Kyrgyzstan, Russia, Tajikistan and Turkmenistan.

Minister of justice of Kazakhstan Marat Beketayev comments on the adoption of the bill:

- This system will increase the level of protection of industrial design rights in the framework of trade activities in the Eurasian space and helps to increase investment attractiveness for the countries participating in this system. The regional patent will expand the opportunities of domestic producers focused on the Eurasian market.

Recall that in Turkmenistan, the Law "On legal protection of industrial designs" was adopted in November 2017. According to the law, an applicant can obtain industrial design protection in their chosen countries, or in all the countries participating in The Hague agreement, by submitting a single application through a national office or through WIPO. Thus, by paying one state fee and filing one application, an applicant can obtain protection of an industrial design in several countries at once, while saving time and money, since it is possible to apply for registration of an industrial design in another country only through a patent attorney - a representative of the country in which it is necessary to obtain protection.
